Welcome to the Italian Bar. These Terms and Conditions ("Terms") govern your use of our website located at ItalianBarDC.com (the "Site") and your visits to, orders from, and reservations with the Italian Bar, located at 5008 Connecticut Avenue NW, #B, Washington, D.C. (the "Business," "we," "us," or "our"). By accessing the Site, placing an order, booking a reservation, or joining our wine club, you agree to be bound by these Terms. If you do not agree, please do not use the Site or our services.

1. Our Services

The Italian Bar offers coffee, cocktails, gelato, food, wine club memberships, and ticketed events, both in-person at our location and, where noted, through online ordering, reservations, or event booking on the Site. Availability, hours, and offerings may change seasonally (for example, extended hours during gelato season) or without notice.

You agree to use the Site only for lawful purposes and in a way that doesn't infringe the rights of, or restrict or inhibit the use and enjoyment of, the Site by anyone else. Prohibited uses include attempting to gain unauthorized access to the Site or its related systems, scraping or harvesting data without our consent, and impersonating any person or entity.

All content on the Site — including our name, logo, photographs, menu descriptions, and other materials — is owned by or licensed to The Italian Bar and is protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

If the Site allows you to submit content (such as reviews, comments, or photos), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with our business. You're responsible for ensuring anything you submit doesn't violate any law or third party's rights.

3. Orders and Payment

Prices for food, beverages, merchandise, wine club memberships, and event tickets are listed on the Site or in-café and are subject to change without notice. All orders are subject to acceptance and availability; we reserve the right to refuse or cancel any order, including due to pricing errors, product unavailability, or suspected fraud.

Payment is due at the time of purchase unless otherwise stated. We accept cash and all major credit cards. For purchases made through the Site, you represent that you're authorized to use the payment method provided.

 

4. Cancellations and Refunds

Cancellations, exchanges, and refunds for café purchases, wine club memberships, and ticketed events are governed by our Refund Policy, which is incorporated into these Terms by reference.

 

5. Reservations and Events

Reservations for tables, wine tastings, and private events are subject to the reservation windows and time limits described in our Policies page. We reserve the right to cancel or reschedule a reservation or event due to circumstances beyond our control, including weather, staffing, or venue issues, in which case we'll offer a refund or the option to reschedule.

 

6. Alcohol Service

We are licensed to serve alcohol in accordance with Washington, D.C. law. You must be 21 or older to purchase or consume alcohol, or to join our wine club, and we reserve the right to request valid identification and to refuse service to anyone who cannot provide it or who appears intoxicated. We reserve the right to refuse alcohol service to any patron at our discretion in accordance with applicable D.C. Alcoholic Beverage and Cannabis Administration (ABCA) regulations.

 

7. House Policies

Use of our physical space, including patio and seating access, wifi availability, outside food and drink, and pets, is governed by our Policies page, which is incorporated into these Terms by reference. We reserve the right to refuse service or ask any patron to leave for failure to comply with these policies or for any conduct that disrupts other guests or staff.

 

8. Third-Party Links and Services

The Site may contain links to third-party websites or services (such as reservation platforms, delivery partners, or social media) that we don't own or control. We aren't responsible for the content, policies, or practices of any third-party site or service, and linking to them doesn't imply our endorsement.

 

9. Disclaimer of Warranties

The Site and our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We don't guarantee that the Site will be uninterrupted, error-free, or secure, or that the information on it (including menu items, prices, or hours) is always current or accurate.

 

10. Limitation of Liability

To the fullest extent permitted by law, the Italian Bar and its owners, employees, and affiliates won't be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or our services, including but not limited to loss of profits, data, or goodwill. Our total liability for any claim arising from your use of the Site or our services will not exceed the amount you paid to us for the specific order, membership, or event giving rise to the claim.

Nothing in these Terms is intended to limit liability in ways not permitted under applicable law, including for gross negligence, willful misconduct, or matters that cannot be limited or excluded as a matter of law (such as liability for foodborne illness caused by our negligence).

 

11. Indemnification

You agree to indemnify and hold harmless the Italian Bar and its owners, employees, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or misuse of the Site or our services.

 

12. Privacy

Our collection and use of personal information (including information collected through wine club sign-ups, reservations, or the Site) is described in our Privacy Policy, which is incorporated into these Terms by reference.

 

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.

 

14. Governing Law

These Terms are governed by the laws of the District of Columbia, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Washington, D.C.
